PRIVACY POLICY

1- Ownership and editiorial responsibility

This Privacy Policy governs the collection and processing of Client data by the DECLAMATUUS, a French limited liability company with a capital of 1,000 euros, registered in the Paris Trade and Companies Register under number 845 191 329, whose offices are 42 Avenue Montaigne, 75008 PARIS, France (hereinafter “DECLAMATUUS“).

In order to provide the Site and process Orders, DECLAMATUUS may collect Personal Data.

The confidentiality of Personal Data is of paramount importance to DECLAMATUUS, which has implemented strict rules and procedures to protect it.

The Client must read this Privacy Policy carefully. The Client is fully informed that the Personal Data submitted and collected will be subject to automated processing.

2- Definitions

For the purposes of this Privacy Policy, the following definitions will apply to all words whose first letter is capitalized, in both singular and plural:

  • Account“: The Client’s account on the Site, accessible via his login and password, and containing his personal information and his history on the Site.
  • Client“: The Client, a consumer or professional, who Orders Products on the Site.
  • GTC“: the DECLAMATUUS GTC, accessible on the Site.
  • «Order» “Ordered“: any order by the Client on the Site.
  • Party“: DECLAMATUUS and/or the Client.
  • Personal Data“: personal data provided by the Client.
  • Privacy Policy“: the present privacy policy of DECLAMATUUS.
  • Product(s)”: the products sold by DECLAMATUUS. These can be personalized on the basis of information provided by the Client during the Order process.
  • Site”: the declamatuus.fr site and its components (computer code, graphic elements, databases, documentation, etc.) published by DECLAMATUUS, as well as any other means of displaying the site (for example a mobile application).

3- Scope and modification of the privacy policy

This Privacy Policy governs the collection, processing and disclosure of Personal Data by DECLAMATUUS, when Clients use the Site and when DECLAMATUUS processes their Orders. It also details the manner in which all data subjects may exercise their rights. 

The Client must read the entire Privacy Policy and accept it without reservation.

This acceptance will be expressed by ticking the box with the mention “I acknowledge having read and accepted the Privacy Policy of the Site” when registering on the Site.

Ticking this box will be deemed to have the same value as a handwritten signature.

DECLAMATUUS reserves the right to modify the Privacy Policy at any time by publishing a new version on its Site, by notifying it by e-mail or by notifying the Client at his next login on the Site.

In the absence of acceptance of the modified Privacy Policy, the Client may exercise its right of refusal by deleting his Account. Prior to deletion of his account, the Client may recover his data.

The applicable Privacy Policy is the last one accepted by the Client.

The DECLAMATUUS website may contain links to third-party websites. They may have a different privacy policy and DECLAMATUUS will not be liable for them.

4– How is data collected?

DECLAMATUUS may collect Personal Data from the Client as follows:

  • When the Client fills in a form on the Site (creation and editing of an Account, providing information to process an Order);
  • When the Client registers on the Site;
  • When the Client subscribes to the DECLAMATUUS newsletter;
  • When the Client places an Order for a Product on the Site;
  • When payments are processed by DECLAMATUUS and its payment service provider;
  • During any contact with DECLAMATUUS related to a problem using the Site or during an Order;
  • When simply browsing the Site;
  • During any contact with DECLAMATUUS.

5- What personal data is collected and for what use?

DECLAMATUUS collects and processes Personal Data in order to fulfill its contractual obligations towards the Client.

However, the Client may refuse to provide some of this Personal Data, it being understood that it may have an impact on the proper functioning of the Site and the Orders.

DECLAMATUUS may collect and process the following Personal Data, if provided:

  • Contact details as well as information of the Client and the recipient (first and last name, e-mail address, telephone number, address);

These contact details and information enable DECLAMATUUS to process Orders and to manage any issue while doing so.

Provided it has given its prior consent, the Client also allows DECLAMATUUS to send him/her information relating to DECLAMATUUS’ offers and activity.

The Client undertakes to have obtained the consent of the person who receives the Order prior to supplying his/her Personal Data to DECLAMATUUS.

This person’s data will be deleted within 2 years after delivery of the Order.

  • Measurements and size of the recipient (body, feet, pierced ears).

These contact details and information enable DECLAMATUUS to process Orders and to manage any issue while doing so.

The Client undertakes to have obtained the consent of the person who receives the Order prior to supplying his Personal Data to DECLAMATUUS.

This person’s data will be deleted within 2 years after delivery of the Order.

  • Information related to connecting to the Site (IP address, type of browser, operating system, place and time of connection, terminal identifier) ;

This information enables DECLAMATUUS to have statistics on the use of the Site and to facilitate its maintenance.

  • Banking and payment information of the Client (last 4 digits of the credit card) ;

These contact details and information enable DECLAMATUUS to process Orders and to manage any issue while doing so.

  • Details of use of the Site, via cookies (quantity of data received, pages viewed, actions carried out);

This information enables DECLAMATUUS to have statistics on the use of the Site and to facilitate its maintenance.

This Personal Data is necessary for DECLAMATUUS to properly carry out its contractual obligations.

6- Payment information

All transactions shall be processed by a payment service provider that complies with the obligations applicable to this activity.

DECLAMATUUS will not have access to the payment information insofar as this information only transits through DECLAMATUUS’ payment service provider.

7- Cookies

DECLAMATUUS may use the following cookies on the Site:

  • Internal cookies that allows to:
    • Collect traffic statistics (number of visits, page views, unfinished orders) in order to monitor and improve the quality of the Site and its services. It is possible to exclude their installation, as they are not mandatory for the Site to function.
    • Adapt the presentation of the Site to the display preferences of the Client’s terminal. It is possible to exclude their installation, as they are not mandatory for the Site to function.
    • Store information entered in forms, manage and secure access to reserved and personal areas such as the Account, manage the Order basket.
    • Provide content, including advertising, related to the Client’s interests and to personalize the offers that are addressed. It is possible to exclude their installation, as they are not mandatory for the Site to function.
    • Send offers by email upon registration by the Client. It is possible to exclude their installation, as they are not mandatory for the Site to function.
  • External cookies such as:
    • Google Analytics (https://marketingplatform.google.com/about/), The purpose of these cookies is to enable DECLAMATUUS to collect traffic statistics. It is possible to exclude their installation, as they are not mandatory for the Site to function.

Only technical cookies cannot be refused, as they are necessary for the Site to function.

The Client has the possibility to accept certain cookies and to refuse others, to accept all of them, or to refuse all of them, it being understood that this may disrupt the functioning of the Site if refused cookies are optional.

These cookies are installed for a maximum duration of thirteen (13) months.

8- Data hosting location

The personal data collected is stored within the European Union, by DECLAMATUUS, which applies industry standards for computer security.

No data will be transferred outside the European Union.

9- Personal data transfer

Personal Data will never be transferred to a third party without the prior consent of the Client.

DECLAMATUUS may transfer Personal Data under the following conditions:

  • If DECLAMATUUS is purchased by a third party, in which case the Personal Data will be transferred to the purchaser, who will be substituted for DECLAMATUUS in the application of this Privacy Policy.
  • If DECLAMATUUS is required to transfer Personal Data in response to a legal obligation.

DECLAMATUUS may call upon the following service providers, who may have access to the Personal Data, which the Client accepts:

  • Payment service provider: Stripe France.
    • DECLAMATUUS will transmit the Client’s payment information to the payment service provider in order to process payments.
  • Site hosting: Greenshift
    • All Personal Data may be stored on the host server.
  • Delivery provider: DHL / Concierge services
    • All Personal Data necessary for the smooth running of a Declamatuus delivery can be stored on the servers of the site host.
  • Collection of marketing consents (cookies): AXEPTIO
    • All the Data necessary for the tracing (cookie) of the Internet user can be stored on the servers of the site host.
  • Billing software: ZERVANT
    • All the Personal Data necessary for the establishment of a tax invoice can be stored on the servers of the site host.
  • Email hosting: IONOS WEB MAIL
    • All messages exchanged as part of the preparation, validation and then monitoring of a commercial transaction with Declamatuus can be stored on the site host’s servers.

These service providers are contractually obligated to comply with their legal and regulatory obligations in terms of personal data.

Personal Data may also be transmitted to any administrative authority upon request, or in application of the law or by court order.

10- Personal data security

DECLAMATUUS ensures that Personal Data is stored under conditions that meet industry standards.

DECLAMATUUS especially undertakes to comply with regulations applicable to Personal Data security and cannot exclude its liability in this respect.

The Site is secured by an SSL certificate.

Communications on the Site are encrypted.

DECLAMATUUS ensures that its employees and service providers responsible for processing Personal Data are subject to an appropriate confidentiality obligation.

In the event of a Personal Data breach, DECLAMATUUS will inform the Client as soon as possible.

DECLAMATUUS will store Personal Data as long as the Account is active.

If the Account has not been active for two (2) years (date of last login), or in the event of deletion of the Account by the Client, Personal Data will be deleted automatically.

In this case, DECLAMATUUS will delete all Personal Data, except those that are strictly necessary to its accounting and to comply with its legal obligations.

11- Rights of data subjects

In accordance with the Data Protection Act and the RGPD, any person concerned has the following rights for all Personal Data transmitted to DECLAMATUUS:

  • Right to access,
  • Right to correct and modify,
  • Right to limit processing,
  • Right to oppose,
  • Right to port.

In accordance with its legal obligations, DECLAMATUUS will comply within a maximum period of one (1) month from receipt of the request.

12- Applicable laws and disputes

The Privacy Policy is governed by French law

The Privacy Policy is written in English, but the French version shall be deemed of superior value.

The Client may submit any dispute relating to the execution or interpretation of the Privacy Policy that is not amicably resolved between the Parties, to the French Data Authority.

It may also be submitted to the competent court of the registered office of DECLAMATUUS, including in case of summary proceedings, third party proceedings or multiple defendants, and regardless of the country of origin of the Client.
